Warranty

All Ross Gardam® products have been designed with longevity in mind, and we’re confident in the quality and craftsmanship of every product we produce. Below you’ll find details of our warranty for our products. If you have any further questions, please feel free to contact us directly.

LIGHTING WARRANTY

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Your purchase is guaranteed against defects in material of manufacturing workmanship, for faults under normal conditions for a certain period of time from the date of purchase. This express warranty extends only to the original purchasers who acquired new product from Ross Gardam® or its distributors and does not exclude, restrict or modify any of your statutory rights or remedies. The warranty terms are accepted by the consumer upon the order of goods and proof of purchase must be provided to make a claim.

A standard five (5) year structural warranty is offered on all our lighting products.

While lamps and LEDs have an indicated average lifespan, this is not guaranteed. All Ross Gardam® supplied LED lamps, integrated LED modules and LED drivers come with a two (2) year replacement warranty, provided proof of purchase has been submitted.

The warranty claim will be deemed void or will not cover the following:

1. The products are contaminated or altered by a third party without prior written consent from Ross Gardam®.

2. If the goods are not used as intended or if the Ross Gardam® Care and Maintenance guide is not adhered to. The Ross Gardam® Care and Maintenance guide can be downloaded from our website.

3. Failure to follow the installation instructions and use provided components, such as drivers, LED modules and/or globes or use of non-Ross Gardam provided components.

4. Product is not installed by qualified person. i.e. a registered electrician.

5. Defects caused by normal wear and tear, accident, negligence, alteration or misuse. This includes products that are exposed to extreme environmental conditions or that have been subject to improper storage.

6. Any costs associated with servicing product.

7. All Ross Gardam® lighting products are intended for dry indoor use, unless specified, and must adhere to the installation requirements as specified in Ross Gardam® product installation instructions.

Ross Gardam® will not be liable for any claims caused directly or indirectly by any event or matter beyond its control, including incidental, consequential or contingent damages suffered as a result of the use or assembly of the lighting fixture or a breach of this warranty either written or implied.

Ross Gardam® will provide repair and make available parts or items free of charge at our discretion. All repairs or replacements will be subject to production schedules at time of notification, clients will be advised on timing either by phone or by email.

All Ross Gardam® products are individually assembled and finished, meaning minor variations in finish, colour and form can occur. Several products include handmade components, including those crafted from glass and timber. These will all have their own unique forms, patterns and/or finishes. Natural materials, such as timber and marble will also have varying colours and grains, this is evidence of their natural and unique qualities. These slight variations are to be expected and will not be accepted as a fault or defect in the product. Colours and finishes as viewed on printed and digital sources are representative only and may not appear identical to the finished product.

Ross Gardam® must be notified within 14 days of delivery of any alleged defect, shortage in quantity, errors, omissions or failure to comply with the description of goods. The potential warranty claim must first be submitted in writing and then accepted prior to any goods being sent. Photos of goods in question must be submitted, alongside the written notification documenting alleged fault or defects. Upon receiving goods for inspection Ross Gardam® may request further information in order to assess validity of warranty claim. You will receive notification whether Ross Gardam® accepts or rejects your claim within 14 days of submission.

The warranty covers the cost involved in the repair but excludes any transport or freight costs associated with the claim. You will need to supply proof of purchase and it is the consumer’s responsibility to cover any cost of delivery of goods back to Ross Gardam® unless expressly stated. Reimbursement of the cost of shipping will be affected in the event that a fault is found with the product as stipulated in our warranty. To claim this, a delivery receipt will need to be provided by you to Ross Gardam®. Once a claim has been accepted, and repair or replacement has been agreed upon, Ross Gardam® will cover the cost of delivery back to the consumer.

FURNITURE WARRANTY

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Structural warranty does not include upholstery which is covered under the warranty of the manufacturer of the upholstery specified. Claims regarding upholstery will be subject to the terms and procedures of the upholsterers. Ross Gardam® can assist in facilitating claims but is not liable for their resolution. A standard five (5) year structural warranty is offered on all our outdoor furniture products from the date of dispatch.

The warranty claim will be deemed void or will not cover the following:

PRODUCT STEWARDSHIP AGREEMENT

Ross Gardam® and its distribution and manufacturing partners are committed to responsible life cycle management and the core principles of product stewardship and extended producer responsibility. We understand that corporate social and environmental responsibility goes beyond the point of sale and warranty periods.

In conjunction with our distributor and manufacturing partners we will take back all products and recycle them in the following ways:

Our product stewardship options include:

Refurbishment of products for possible reuse by the existing customer or on selling/remarketing to new customers.
On selling or donating of products in existing condition to other commercial businesses or organisations.
Disassembly of products for component and/or materials reuse in new product manufacturing.
Recycling components if reuse is deemed unfeasible.

Our product stewardship agreement is based on the following terms:

All returns need to be agreed upon by Ross Gardam® in advance of them being delivered to us.
The customer is responsible for all onsite disassembly and related costs. We recommend using qualified tradespeople and electricians.
The customer is responsible for any delivery fees to the agreed location.
Goods are to be returned as supplied and not have any contaminates or be altered by a third party in any way. If goods are supplied contaminated they will be returned to the customer at their cost.
