Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality.
Your purchase is guaranteed against defects in material or manufacturing workmanship, for faults under normal conditions for a certain period of time from the date of purchase. Our express warranty is in addition to the specific rights granted by Victorian and Federal laws. This express warranty does not include, restrict or modify any of your statutory rights or remedies. The consumer accepts the warranty terms upon the order of goods either through the Ross Gardam website, distributors, or through direct sale.
A standard two(2) year structural warranty is offered on all our lighting products.
While lamps and LEDs have an indicated average lifespan, this is not guaranteed. All Ross Gardam® supplied LED lamps and integrated LED modules come with a (2) year replacement warranty, provided proof of purchase has been submitted.
The warranty claim will be deemed void or will not cover the following:
The products are contaminated or altered by a third party without prior written consent from Ross Gardam®.
If the goods are not used as intended or if Ross Gardam® Care and Maintenance guide is not adhered to. Each lighting product has a sticker attached showing the maximum wattage globe to be used in each fitting. The warranty will be voided if maximum wattages are not adhered to. Product not installed by a qualified person. i.e. a registered electrician.
Defects caused by normal wear and tear, accident, negligence, alteration, or misuse. Any costs associated with servicing the product.
All Ross Gardam® lighting products are intended for dry indoor use, unless specified, and must adhere to the installation requirements as specified in Ross Gardam® Product Installation Instructions.
Ross Gardam® will not be liable for any claims caused directly or indirectly by any event or matter beyond its control, including incidental, consequential, or contingent damages suffered as a result of the use or assembly of the lighting fixture or a breach of this warranty either written or implied.
Ross Gardam® will provide repair and make available parts or items free of charge at our discretion. All repairs or replacements will be subject to production schedules at the time of notification, clients will be advised on timing either by phone or by email.
Ross Gardam® will not be liable for any costs or fees associated with the installation, removal, de-installation; reinstallation, or restoration of any faulty or damaged goods, including the reinstallation or integration of faulty LED modules.
Ross Gardam® will not be liable for any courier mishandling or damages incurred during freight where freight insurance has not to been paid on the goods invoice.
Ross Gardam® must first be notified of a potential warranty claim in writing and then agree to acceptance prior to any goods being sent. Photos of goods in question must be submitted alongside the written notification documenting alleged fault or defects. Upon receiving goods for inspection Ross Gardam® may request further information in order to assess the validity of the warranty claim. You will receive notification whether Ross Gardam® accepts or rejects your claim within 14 days of submission.
The warranty covers the cost involved in the repair but excludes any transport or freight costs associated with the claim. Please note you will need to supply proof of purchase and it is the consumer’s responsibility to cover any cost of delivery of goods back to Ross Gardam® unless expressly stated. Once a claim has been accepted, and repair or replacement has been agreed upon, Ross Gardam® will cover the cost of delivery back to the consumer.
Reimbursement of the cost of shipping will be affected in the event that a fault is found with the product as stipulated in our warranty. To claim this, a delivery receipt will need to be provided by you to Ross Gardam®.
